Placing an order for goods using this website shall be deemed conclusive evidence of the buyer’s acceptance of these Terms and Conditions. Any variation to these Terms and Conditions (including any special terms and conditions agreed between the buyer and seller) shall be inapplicable unless agreed to in writing by the Seller.
When a buyer places an order, he or she agrees pursuant to these Terms & Conditions and is subject to acceptance by the seller under all circumstances. The seller may choose not to accept an order or decline a sale for any reason. Under certain circumstances, 123 Studio Toybox Collectibles reserves the right to charge restocking fees of no less than 20% when applicable.
All orders placed on the 123 Studio Toybox Collectibles website for any and all merchandise, additional services and delivery & shipping costs and services are officially subject to any and all prices that are shown in the Cart at the time of checkout. In addition, confirmation emails are usually sent to buyers who have submitted an official order in the 123 Studio Toybox Collectibles' Cart, however, where applicable, the CART overrules all emails in the event of a dispute on price. Prices for goods and services on this website are exclusive of delivery costs and/or services including handling, insurance or additional special delivery charges. Prices outside of the actual cost for goods and services are usually supplied to the buyer at the time a sale or order is created. In cases where shipping costs verification is necessary, the customer is notified after an order has been placed, usually by email.
An "Additional Services" offer or "Special Offer" is an option that could be made available at any time. The offer may be in the form of either a service or a product and is offered at a point in time when you are ready to check out. Any FEE associated with such an offer is clearly indicated before you confirm your acceptance allowing you to decide whether or not to accept the "Service" or "Offer" being made to you. If you accept, then the stated fee is added to your checkout total automatically.
Orders are accepted from any country in the World. We ship packages once a week, usually on Friday. If you are looking for a gift item and need to have it for a specific point in time, it is always a good idea to let us know so that we can tell you if your item will ship in time. You are welcome to request a rush order to be placed on your package for a fee. This would insure that your items would ship out within 24 hours of either receipt of your payment or if paying by check, within 24hrs after the 10 day clearance of payment expires as explained below under Payment Options & Policy. ALL packages are sent by the United States Postal Service and in most cases will have a tracking number available. Please be aware that the USPS may not offer tracking on many international packages. However, if you need an update on a package that does have available tracking, let us know and we will promptly get you that information. By email, quotes for shipping & handling charges are available upon request at any time before an order is made.
It is understood that time of delivery shall not be the responsibility of the Seller and that the seller shall not be liable for any losses, costs, damages or expenses incurred by the buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date. Likewise, incorrect shipping addresses given to us without notification of a correction before your package leaves our facility are the responsibility of the buyer.
Quotes and estimates for delivery times are expressly given AS IS as supplied to us by the carrier that we use. Delivery of the goods shall be made to the buyer’s address specified in the order and the buyer shall make all arrangements necessary to take delivery whenever the goods arrive at the intended destination. Title and risk in the goods shall pass to the buyer upon delivery. The seller takes no responsibility where an incorrect address is supplied. The seller takes no responsibility after the carrier confirms the delivery where either packages are intercepted by someone other than the addressee or where theft of property from the addressee's address occurs.
Note for International orders: Restrictions may apply on some items prohibiting them from being shipped to certain countries outside of the U.S. Feel free to visit the United States Postal Service website on the details for each country and what items are prohibited. You should also understand that your customs department may charge you a fee based on the value of your shipment at the time of delivery. For more details, see about valuing your shipment under INSURANCE just below as "123StudioToyboxCollectibles" will not be responsible for these charges.
Goods that appear as available on this website are on a first come first serve basis. We work hard to keep our inventory numbers accurate and up to date but it is possible with our quickly changing stock that availability can change before we've had a chance to perform an update. We also reserve the right to remove items from stock at any time. Therefore, "123StudioToyboxCollectibles" takes no responsibility for inaccuracies in it's inventory and will not be liable to anyone for not being able to complete an order or a sale. If after you have paid for merchandise, we are not able to fill your order in any way, we will allow you the option of either choosing a replacement item or receiving a refund in the same manner that you paid.
Because most of the goods we sell are from secondary markets, warranty is limited to the description that is clearly stated for each item. All goods are sold AS IS. For more details on item returns, see our Return/Refund Policy.
Insurance is not available for all countries outside of the U.S. We will inform those ordering from outside the U.S. on whether or not your international order can be insured. For all US orders and those international orders that qualify for coverage, insurance will be paid out only in the form of an identical REPLACEMENT item, not a refund, so long as the item is still available(See Return/Refund Policy below for the exception to the rule). Insurance will only be added if you request it and if available. WE ARE NOT RESPONSIBLE FOR DAMAGES OR LOSS ON ANY ORDERS THAT DO NOT HAVE INSURANCE. However, if a package that is insured does happen to get damaged in transit, then the merchandise including the damaged packaging that it was shipped in must be returned to us inside a new package so that we can use that evidence to support the claim to be filed with the US Post Office from our end. Only after the Post Office has reviewed the evidence and confirms the reimbursement, can we then send you a REPLACEMENT item. Similarly under the coverage of insurance, if a package gets lost in transit, the Post Office requires a 30 day period of time to expire from the date of shipping before reimbursement can be made. Note for International orders with Insurance: By valuing your package for purposes of insuring it, you should understand that your customs department may charge you a fee based on that value at the time of delivery. Please be aware of this before you choose to insure your item and check with your customs office to see what charges may apply as "123StudioToyboxCollectibles" will not be responsible for these charges.

WE DO NOT ACCEPT PAY PAL
Many people feel comfortable in using the Paypal service but it has been our experience that Paypal has caused financial headaches. It is possible that an entire Paypal account could be frozen due to a single customer transaction issue. This in turn could lead to customer funds being frozen having nothing to do with the actual problem. The possibility for such an inconvenience to our customers is one that we wish not to allow the opportunity for.
We offer our customers the safest form of payment, that being their own credit card through our secure online Merchant Account.
You can use one of the following cards to make your purchase.
All merchandise, additional services and delivery & shipping costs and services are required to be paid up front before any goods and/or services can be delivered. Merchandise is held for three days to allow you time enough to make your payment when using a credit card and seven days for all other Payments by Mail as outlined below. When using a Payment by Mail, if you feel that your payment cannot be postmarked within seven days, you may send us an EMAIL to request an additional seven day payment extension. However if we receive no credit card payment within 3 days or notification from you after 7 days for a payment extension or a postmarked payment within 2 weeks, then restocking fees will apply to reorders beyond that period of time of no less than 20%.
Other available options for making payments are as follows:
"Money Order"(US Bank, Store or Postal or International Money Order for US dollars on foreign shipments)
"Personal Check"(Because of the quick turnover on many of the types of goods that we sell and the forced minimum 10 to 14 day waiting period for checks to clear, personal checks can only be accepted if you agree to the following... If for whatever reason your check does not clear, you will be required to pay an additional $25 banking fee to the total amount due for your order. It is possible that a wait time of up to 3-4 weeks for delivery of your package can occur when using this form of payment.)
"Bank Cashier's Check"(Only US issued Bank checks are accepted)
"U.S. Cash"(NOT EURO, Can be sent at your own risk. Euro is not accepted in the US. There are ways to send US cash in an envelope using various services that the US Postal Service provides so that it would have a far less risk of being lost. "Priority" for example. Or even "Signature confirmation" to assure that it gets to it's destination. These services are available for a very minimal fee from the US Postal Service and sending payments this way can sometimes be a good alternative depending upon your situation.)
NOTE: International orders that request to use credit cards for payment must be pre-approved by us before we can accept payment. There is an increasing number of fraud buyers from overseas and we may need to ask for additional information before an order can be confirmed so please be patient with us. It is for everyone's protection that we do this.
RETURN/REFUND POLICY: Top
Because we sell goods both new and used, each product is described as such. While we take care in describing all the items we sell as best as we can, it should not be assumed that the goods we describe are anything other than what is stated in the description. Because most of the goods we sell are from secondary markets, we have no way of returning items for refunds, so it is important for you to email us with any questions or doubts you may have regarding packaging and condition BEFORE making your purchase. Once you take delivery of the goods, you have 3 days to notify us of any issues after which time you shall be deemed to have accepted the goods.
ALL SALES ARE FINAL. A refund can only be issued under the following two circumstances:
A. If an obvious mistake was made on our part in the description of any of the goods that we sell. For instance, you ordered the color Blue and you got the color Red instead. If by chance you were sent an item other than what you paid for by mistake, then an exchange will be made for the right item to correct that mistake. If the right item happens to be out of stock, then you will be issued a refund or credit(your choice) towards another item.
B. Similarly, if goods that were insured are damaged or lost in transit, then identical REPLACEMENT(S) would normally be sent out(See Insurance info above) unless the item is no longer available. In that case then you would be issued a refund for the purchase price.
NOTE: Any refunds that are made will be the purchase price only, not the shipping & handling charges. Shipping & handling charges are NOT refundable. Returns must be received within 7 days of notification request accompanied by an (RMA)Return Merchandise Authorization number which you will get from us via email. We reserve the right to charge a 20% restocking fee on all returns.
Please note: Orders may be cancelled only prior to your package having left our facility on it's way to the carrier. Once your package has left our facility, it is deemed shipped at which time we will not have the ability to cancel the order. A tracking number for your order can be provided only upon request if needed for any reason. For more on SHIPPING, please see the details under that heading by scrolling up above.

HOW TO VIEW THE ITEMS IN YOUR CART:
Click the button that says "Click to View Cart" in the upper most left corner of the page. You must then select a shipping location from the Country or/and State drop down lists. Once you do, you'll be able to scroll down the invoice that appears with the details of your order. It is only possible to view the cart by clicking the "Click to View Cart" button. The cart CANNOT be opened by using the back or forward arrows on the browser. If cart is "OPEN" then a browser arrow click will close cart and show a store page depending on the arrow direction selected.
CHECK OUT & PAY FOR YOUR ORDER (USA ONLY):
Once after you've selected a shipping location, you will have the option at the top of that page to either use a "Credit Card" or send a "Payment by Mail" to pay for your order. You can also select whether or not to "Insure" your order or add "Rush Order" services as well. Keep in mind that once you click the "CONFIRM" button, your order becomes official and changes are no longer allowed. At that point, you may only select to either pay for your order by Paper Payment or Credit Card. Just simply follow the instructions that are given to complete your transaction and if you have any questions, feel free to contact us at any time.
Please note that ALL international orders must be pre-approved before payments can be accepted due to the high volume of Internet fraud. In addition we would like to ensure that you are not overpaying for shipping & handling costs. WHAT HAPPENS AFTER YOU SUBMIT AN ORDER:
In all cases except for when you are opting to change from sending a payment via regular mail to payment by Credit Card, after you've submitted an order or confirmed that you intend to send payment via regular mail, the store will NOT allow any further movement or selections of product. The store works this way to prevent you from accidentally placing a duplicate order. When you try to move around in the store after you've submitted an order or confirmed that you intend to send payment via regular mail, most actions will show a message informing you that an order has recently been completed. In order to continue, you must start a new session by clicking the "Empty Cart & Start Over" button located at the top left corner of the page. Doing so will allow you to begin a new order or just look around further within the store. NOTE: You should NOT use the browser refresh/reload or an F5 key reload as that will NOT reset the store correctly.
